New Panel of SCSI Construction Adjudicators

The provisions of the Construction Contracts Act 2013 applies to all Construction Contracts entered into after 25 July 2016.

This Act, which introduces a statutory payment process, will aid cash flow in the construction industry and ensure parties have effective remedies where disputes arise, through the introduction of a new statutory dispute resolution process known as Adjudication.

Adjudication offers a quick and efficient alternative to other forms of dispute resolution, providing a temporary binding decision within a 28 to 42-day period from the issue of the referral to the adjudicator.

The assessment of payments has always been a fundamental element of a Chartered Quantity Surveyor's job; therefore, where there is a dispute relating to payment, a Chartered Quantity Surveyor is the professional best suited to act in the role as the Adjudicator or party advisor.

Whilst part 6(4) of the Act allows for parties to refer to a Minister’s Panel, in circumstances where they have failed to agree an Adjudicator themselves, part 6(1) gives parties the opportunity to agree an adjudicator by mutual consent. For this purpose, the Society has formed its own panel of Adjudicators, following a stringent interview process.

We therefore would encourage parties to such payment disputes to

- Either draw from the SCSI panel directly and choose an Adjudicator themselves (details of panel below), or
- Alternatively, request the President of the Society of Chartered Surveyors Ireland to nominate on their behalf.
